A Preliminary Discussion on the Sealing System of Minor Criminal Records

Abstract:Tesalingsystemofminorcriminalrecordsrepresentsacrtical explorationinadvancing judicialcivilizationandmodizingsocialgoverance.Anchoredontheconceptof“expungement”，thisstudydfinesminorcrimsasofensespunishablebyfied-ter imprisonmentofnomorethantreeyearsunderstatutorylawandproposesthatlegislationshouldlarifythescope，proceures，adelief mechanismforsaling.Findingsrevealthesystem’spotentialtoefectivelyeliminatesocialisriminationeducercidiismandalign withtheprincipleofmoderationincriminallaw.Drawinglesonsfromjuvenilerecodsealingpracticesndoverseaspractics，thepaper proposesadual-trackmodelcombining“statutorynmumsentencswithsubstantiveaessments”，dvocatesforacodinatedhaism among publicsecurityorgans，procuratorates，courts，ndjudicialadministrativeorgans，andrecommendscomplementarymeasuressuchas employmentsupportanddataisolation.Theserefomsaimtobalanceofenderrightsprotectionwiththeeficacyofsocial goveance.

在刑事司法領(lǐng)域，犯罪者服刑完畢后的諸多權(quán)益都被犯罪記錄所影響，特別是對(duì)于那些實(shí)施輕微犯罪行為的偶犯、初犯，犯罪記錄可能阻礙他們回歸社會(huì)，從而引發(fā)一系列社會(huì)問題，這給本著教育挽救方針的刑事治理政策帶來了新挑戰(zhàn)。（剩余6044字）
