Abstract:Generativeartificialintellgence(A)paintinghsdeveloedapidlyandbecomeidespreadbringingwithitteriskof copyrightinfringeentichsaroadsocialipact.TetchicalcharacteristicsofgenerativeAIpaintingicudedeepagapbilitiesandrelianceonmassiveamountsoftrainingdata.Combiningdomesticandinteratioaljudicialcases,copyightifrngentan bedividedintotwocategoris:infringementofexistingcopyightholdersbyrainigdataandinfringeentfacedbygeneratieAworks, suchasmisapropratioThreareanydiultisineprocessofgulatingopightinfringentcludingiguityinetei ningcopyrightoershipofgenerativeAworks,videntarydifcisinrainingdatainfringementcases,ndtelackofectivegov eranceftragdaesTtielyatergtdlaeoloaliovaiglatioiisd idetifyAIpaintingcopyghtsbasedontheorigialcontributiosofusers,exploretheuleofreversedburdnofproofinraningdatainfringement cases,and strengthen the governance of the source and content of training data.
