自動駕駛機動車交通事故侵權(quán)責任主體研究

摘 要：近年來，人工智能的熱潮席卷全球，自動駕駛作為人工智能的標志性應(yīng)用之一，毫無疑問將會帶來巨大的社會效益。但是多起自動駕駛事故也警示我們應(yīng)重視由自動駕駛機動車所引發(fā)的侵權(quán)問題。立足于自動駕駛的特性以及分級，來分析不同等級的自動駕駛機動車導(dǎo)致的交通事故中，損害賠償責任主體的認定問題。

Research on the Subject of Tortious Liability for Autonomous Vehicle Traffic Accidents

Abstract：In recent years， the boom of artificial intelligence has swept the world， and autonomous driving， as one of the iconic applications of artificial intelligence， will undoubtedly bring huge social benefits. However， a number of autonomous driving accidents also warn us that we should pay attention to the infringement caused by autonomous vehicles. Based on the characteristics and classification of automatic driving， the article will analyze the identification of the subject of damage compensation liability in traffic accidents caused by different levels of autonomous vehicles.

1 自動駕駛機動車概述

1.1 自動駕駛機動車的概念及特性

根據(jù)《智能汽車創(chuàng)新發(fā)展戰(zhàn)略》（征求意見稿），智能汽車是指通過搭載先進傳感器、控制器、執(zhí)行器等裝置，運用信息互通、互聯(lián)網(wǎng)、大數(shù)據(jù)、云計算、人工智能等新技術(shù)，具有部分或完全自動駕駛功能，由單純交通運輸工具逐步向智能移動空間轉(zhuǎn)變的新一代汽車。（剩余4939字）
