Abstract:In order to explore the criteria for the recognition of labor relations in platform work,this articleselects120pieces of judicial documents tocarryempiricalanalysis,andtheresultsshowthat the proportionof judgments recognizingilabor relations is slightlylarger,andthe“subordination”as an objective factor is emphasized.There is adifferencebetween theattitudeof judicial practice towards the two.The key points of the judgment of the distribution-type platformwork include:examining the essence of the work through the surface of agreement,andicomprehensively analyzing based on“subordination”and the content of the work.The key points of the judgment ofithe network service platform work include:arguing theof the network live protocol from the agreement and appearance,and identifying the“dominant management”of the economicsubordinationand personal subordination.Itis necessarytoclarifytherecognitionof laborrelationsin platform work should stillbe subject to the substantive judgment of“subordination”,and the issue of labor relations in platform work should be reflected from perspective of algorithm control.

一、引言
本研究以“北大法寶"數(shù)據(jù)庫為支撐,在“全文檢索"中輸人關(guān)鍵詞“勞動(dòng)關(guān)系” + “平臺(tái)"和“勞動(dòng)關(guān)系” + “平臺(tái)用工”,經(jīng)篩查選取2018一2024年間共計(jì)120份生效民事判決書作為平臺(tái)用工勞動(dòng)關(guān)系認(rèn)定的研究樣本,從數(shù)據(jù)層面直觀呈現(xiàn)平臺(tái)用工中勞動(dòng)關(guān)系認(rèn)定的影響因素。(剩余6966字)
