Research on Online Mediation Mechanism for Cross-border Digital Intellectual PropertyDisputes

Abstract: [Purposes] The Singapore Mediation Convention provides a new approach to resolve cross一 border digital intellectual property disputes,but China's current mediation system has not been fully aligned with the Convention.This study analyzes the characteristics of digital intellectual property disputes,the limitations of traditional intellectual property mediation mechanisms,and the current status of online mediation mechanisms,in order to provide suggestions for improving the online mediation mechanism for cross-border digital intellctual property disputes in China.[Methods] This paper analyzes the concept of digital intellectual property rights and the feasibility of mediationas a solution to cross-border intellctual property disputes,compares and discusses the current online mediation mechanism of digital intellctual property rights at homeand abroad,and combines the practice of digital trade platforms,Internet names and digital address assgnment agencies (ICANN ）and other platforms and organizations in the settlement of intellectual property disputes,and puts forward the improvement path of China's online mediation mechanism of cross-border digital intellectual property rights.[Findings] This paper proposes to learn from the experience of eBay's intellectual property dispute resolution,improve the mediation enforcement mechanism,enhance the awareness of digital intellectual property protection of enterprises,optimizing the personnel, systems,and procedures of the online mediation mechanism to improve China 's intellctual property online mediation mechanism.[Conclusions] China should accelerate the constructionof an online mediation mechanism for cross-border digital intellectual property rights to solve the problem of safeguarding rights in the resolution of cross-border digital intellectual property disputes.
