推進鄉(xiāng)村治理法治化的價值困境與路徑選擇

摘  要：鄉(xiāng)村治理法治化具有自身獨特的價值內(nèi)涵。當前我國鄉(xiāng)村治理法治化建設取得很大成效，但同時仍面臨治理主體意識缺失、傳統(tǒng)文化消解、功利化價值趨向等困境。建構具有倫理價值的新時代鄉(xiāng)村治理法治化秩序，應從多元主體共治、權力與權利平衡、德治與法治相容等方面探尋運行路徑。

Abstract： The legalization of rural governance has its own unique value connotation. At present， great achievements have been made in the construction of the rule of law of rural governance in China， but at the same time， it is still faced with some difficulties， such as the lack of governance subject consciousness， the digestion of traditional culture， the trend of utilitarian value and so on. In order to construct the legal order of rural governance in the new era with ethical value， we should explore the operation path from the aspects of the co-governance of multiple subjects， the balance of power and rights， and the compatibility of the rule of virtue and the rule of law.
