綁架贖金的發(fā)展演進法理分析及應對建議

摘要：綁架贖金出現(xiàn)在綁架案件、恐怖主義犯罪和海盜案件中，催生了綁架贖金險的問世和各國贖金規(guī)則的產(chǎn)生。贖金具有特殊的性質(zhì)和特點，各國對贖金的合法性與合理性進行了探討，采取的態(tài)度各不相同。我國對贖金問題應當結合理論與實踐采取恰當?shù)膽獙Σ呗?，制定符合國情的贖金規(guī)則。

On the Development， Jurisprudential Analysis and Countermeasures of Kidnapping Ransom

Abstract：Ransom appears in cases of kidnapping， terrorism and piracy， which leads to the emergence of Kidnap&ransom insurance and ransom rules in various countries. Ransom has special nature and characters， various countries have discussed the legality and rationality of ransom and adopted different attitudes. China should take appropriate countermeasures to the ransom problems in combination with theory and practice， and formulate ransom rules in accordance with national conditions.

一、綁架贖金概述

（一）綁架贖金的概念

在綁架案件、恐怖主義犯罪和海盜案件中，綁匪通常以人質(zhì)的人身安全或者特定物的財產(chǎn)安全為籌碼，向特定對象提出交付財物或者兌現(xiàn)特定事項的要求。（剩余7320字）
