創(chuàng)造性評判中“三步法”的合理運用

摘  要：該文通過《專利審查指南》中對評價發(fā)明專利申請創(chuàng)造性的“三步法”的多次修改完善，引發(fā)在實際的實質審查過程如何避免機械化運用“三步法”的思考，并結合實際案例解析，明晰合理運用“三步法”對發(fā)明專利申請進行創(chuàng)造性評判的重要性。

Abstract： The paper relates to a method for evaluating the inventive step of patent applications for invention， which is characterized in that a "three-step methodology" is amended and perfected for many times through a "GUIDELINES FOR PATENT EXAMINATION"， so that the thinking of avoiding applying the "three-step methodology" mechanically in the actual examination process is initiated， and the importance of creativity evaluation on the patent applications for invention by reasonably applying the "three-step methodology" is clearly achieved by combining with the analysis of actual cases.
