摘要：《海商法》是中華人民共和國成立以來第一部完整規(guī)定海事法律制度的法律規(guī)范，迄今已實施三十年。在回顧該法誕生的艱辛歷程和三十年來取得的輝煌成就、客觀評述該法的先進性特征和歷史貢獻的基礎(chǔ)上，總結(jié)修改《海商法》的時代背景，澄清修法中的認(rèn)識誤區(qū)，使之在海洋強國的建設(shè)中發(fā)揮更大作用。

Abstract：Chinese Maritime Code is the first law that fully stipulates the maritime legal system since the founding of the People’s Republic of China， and has been implemented for 30 years. On the basis of reviewing the hard process of the Code’s birth and the brilliant achievements in the past 30 years， and objectively commenting on the progressiveness characteristics and historical contributions of the Code， this paper summarizes the era background of the revision of the Chinese Maritime Code， clarifies the misunderstanding in the revision of the Code， and makes it play a greater role in the construction of a maritime power.
